Anti Rape Bill 2013

Anti Rape Bill 2013 has been passed in Lok Sabha and Rajya Sabha .

The Lok Sabha on 19th March 2013, passed the Criminal Law (Amendment) Bill 2013, to provide stern punishment for crimes against women. For the first time the new anti-rape law imposes various penalties for voyeurism, stalking and acid attack.

Rajya Sabha passed the bill on 21st March 2013.

The President of India has accorded his assent to the bill on 2nd April 2013, now it will be called The Criminal Law Amendment Act(2013).

Key Highlights of The Bill

1- Punishment for Non Treatment of Victim– Whether Public or Private hospital, whosoever in charge if denies to treat the victim shall be punishable with imprisonment Up-to 1 yr or Fine or Both.

For the first time it has been made a punishable offence for police personnel not to register a FIR.(Min Imprisonment up-to 6 months which may extend up-to 2 yrs with fine)

2- Acid Attack– Shall be Punished with not less than 10 years of imprisonment.

3- Sexual Harassment– Any Man committing any of the following acts-

(a) Physical contact and advances involving unwelcome and explicit sexual overtures, or

(b)A demand or request for Sexual favors, or

(c) Showing pornography against the will of women ;

shall be punished with rigorous imprisonment which may extend up-to 3 yrs or  fine or both.

Making sexually colored comments shall be punished with fine or imprisonment which may extend up-to 1 yr or both.

4- Voyeurism- Shall be  punished with rigorous imprisonment  of 1 yr which may extend up-to 3 yrs or  fine or both, and in subsequent conviction min imprisonment will be 3 yrs which may extend up-to 7 yrs and shall also be liable to fine.

5- Stalking- Whosoever involved in the offence of stalking shall be punished with imprisonment of not less than 1 yr which may extend up- to 3 yrs and shall also be liable to fine, and in subsequent conviction imprisonment may extend up-to 5 yrs and shall also be liable to fine.

6- Rape Whosoever involved in the offence of Rape shall be punished with imprisonment of not less than 7 yr which may extend up-to Life term and shall also be liable to fine.

Having Sex with wife who is not below 15 yrs of age will not be considered Rape.

Punishment for causing death or vegetative state of victim due to Rape shall be punished with rigorous imprisonment of not less than 20 yrs which may extend for life term( i.e Remaining natural life of the offender or death)

Offenders who are from Police, or are Public servants  members of armed forces or hospital management or staff would face a minimum jail term of 10 yrs with provisions for extension to life imprisonment and a fine.

Gang Rape convicts would be awarded rigorous imprisonment of 20 yrs which may extend for life term (i.e Remaining natural life of the offender or death)

7- Trafficking :  Trafficking of  a person- Imprisonment of Min 7 yrs which may extend up-to 10 yrs with fine .
